1. Acceptance of Terms
By accessing or using Policy Balance Hub (“the Service”), operated by Policy Balance Hub (“we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Policy Balance Hub is a cloud-based insurance premium reconciliation platform that provides automated matching of payments, commissions, and carrier statements. The Service includes carrier statement OCR, commission split tracking, trust account compliance monitoring, and related features.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscription and Billing
The Service is offered on a subscription basis. Pricing details are available on our Pricing page. All fees are non-refundable unless otherwise specified. We reserve the right to change pricing with 30 days written notice. Billing is processed securely through Stripe.
5. Free Trial
We offer a 14-day free trial for new accounts. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.
6. Your Data
You retain all rights to the data you upload to the Service. We do not claim ownership of your data. We process your data solely to provide the Service and as described in our Privacy Policy. You are responsible for ensuring you have the right to upload any data you provide.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the integrity of the Service
- Upload malicious code, viruses, or harmful data
- Resell, sublicense, or redistribute the Service without authorization
- Reverse engineer, decompile, or disassemble the Service
8. Intellectual Property
The Service, including all software, designs, text, and graphics, is the property of Policy Balance Hub and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
9. Limitation of Liability
To the maximum extent permitted by law, Policy Balance Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Policy Balance Hub is a reconciliation tool and does not constitute financial, legal, or accounting advice.
11. Termination
Either party may terminate the subscription at any time. Upon termination, your access to the Service will be discontinued. We will make your data available for export for 30 days following termination. After that period, your data will be permanently deleted.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
